Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the OX Shops platform, including our marketing website, dashboard, APIs, and the storefronts you create (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

OX Shops provides software that lets merchants build, host, and operate branded online stores under an oxshops.com subdomain or a custom domain. We provide the tools; you provide the store, its products, and its policies.

2. Accounts

You must provide accurate information when you register and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Plans, fees, and billing

Paid plans are billed on a recurring basis, and a one-time activation fee is charged when you take a store live. Fees are non-refundable except as described in our Refund Policy or as required by law. We may change our pricing on a going-forward basis with reasonable notice.

4. Merchant responsibilities

You are solely responsible for your store and everything you sell through it, including:

  • The accuracy of your product listings, pricing, and inventory.
  • Fulfilling orders, handling returns, and providing customer support to your buyers.
  • Publishing and honoring your own store policies — including your privacy policy, terms of sale, shipping policy, and refund policy. The platform-level policies here do not replace the policies you must provide to your own customers.
  • Complying with all applicable laws, taxes, and the rules of any payment provider you enable (such as Stripe, WiPay, or Fygaro).

5. Acceptable use

You agree not to use the Service to:

  • Violate any law or the rights of others.
  • Sell prohibited, counterfeit, or illegal goods, or engage in fraudulent activity.
  • Upload malware, attempt to breach security, or interfere with the operation of the Service.
  • Send unsolicited or unlawful communications.

We may suspend or terminate stores that violate these Terms or that create risk or possible legal exposure for us or our users.

6. Payments to buyers

OX Shops is not a party to the sales between merchants and their customers. We do not take possession of the goods sold and are not responsible for the quality, safety, legality, or delivery of any items. Disputes between a merchant and a buyer are between those parties.

7. Intellectual property

We retain all rights in the Service and our own trademarks. You retain ownership of the content you upload, and you grant us the license necessary to host and display that content in order to operate your store.

8. Termination

You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that could harm us or others. Certain provisions survive termination, including those relating to fees owed, intellectual property, disclaimers, and limitations of liability.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, OX Shops will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months preceding the claim.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and provide notice where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
